1. General Information

Welcome to Aing Kimsan Bicycle Shop & Rental (“we,” “our,” “us”). By using our website, purchasing our products, renting our equipment, or utilizing any of our services, you agree to the following Terms and Conditions. These Terms aim to ensure a safe, fair, and enjoyable experience for all our customers.

2. Definitions

• “Company” refers to Aing Kimsan Bicycle Shop & Rental, including its staff, owners, and subsidiaries.
• “Customer” refers to any individual or organization purchasing or renting equipment or utilizing services from the Company.
• “Rental Equipment” includes bicycles, e-scooters, motorbikes, trailers, and associated accessories provided for temporary use under the rental agreement.
• “Services” refers to maintenance, repairs, rentals, guided tours, and other services provided by the Company.

3. Product Sales

3.1 Warranty:

• The respective manufacturer’s warranty covers all products sold by the Company. Specific warranty durations and conditions will be provided at the time of purchase.
• The Company does not provide additional warranties beyond the manufacturer’s terms.
• Warranty claims must be accompanied by proof of purchase, and products must not have been tampered with or misused.

3.2 Returns:

• Customers may return items in their original, unused condition within 14 days for a refund or exchange.
• Any items returned must include the original packaging, tags, and receipt.
• Customized or clearance items are non-refundable.
• Refunds will exclude shipping or delivery fees unless the return is due to a defect.

4. Rental Terms

4.1 Rental Agreement:

By renting equipment from the Company, the Customer agrees to:

• Carefully inspect the equipment upon collection to ensure it is in good working condition.
• Return the equipment in the same condition it was rented, excluding reasonable wear and tear.
• Use the equipment only for its intended purpose and refrain from activities that could cause excessive wear or damage.
• Before renting any fleet, you must sign a liability form acknowledging your acceptance of the Company’s rental conditions and your responsibility for any risks.

4.2 Rental Duration:

• Rental of bicycles, e-scooters, and EMTBs is based on a day charge from 7 AM to 8 PM.
• For motorcycles, the rental period is 24 hours from pickup.
• Late returns will incur a $2 per hour charge.

4.3 Deposit:

• A refundable security deposit may be required before the rental equipment is handed over.
• For motorcycles, only cash or a passport is accepted as a deposit.
• For other rentals, accepted deposit methods include cash, passport, ID card, or driving license.
• The deposit will be returned upon satisfactory inspection of the returned equipment, minus any damages or late return charges.

4.4 Payment Methods:

• In-store payment options include cash, check, and credit card.
• Payments made via credit card incur a 3% extra fee, and a 10% tax is added.

4.5 GPS Tracking:

• All motorcycles and EMTBs are equipped with GPS tracking for security and monitoring purposes.
• The Company reserves the right to track and locate rental equipment if necessary.

4.6 Liability:

• The Company provides no insurance coverage for any rentals or services.
• Customers assume full responsibility for their safety and any damages, injuries, or losses incurred during the rental period.
• The Company is not liable for accidents, injuries, or damages to third parties caused by the Customer’s use of the rental equipment.
• If the equipment is damaged or lost, repair or replacement costs will be charged, and the customer must pay any associated costs exceeding the deposit amount.
• Before renting any equipment, the customer agrees to Sign a Liability Form acknowledging that they understand and accept these risks.

4.7 Prohibited Uses:

• Customers must not use the equipment for racing, stunts, or off-road activities unless explicitly permitted by the rental agreement.
• Equipment must not be subleased or rented to a third party without prior authorization from the Company.

5. Tours and Group Bookings

5.1 Booking Confirmation:

• A deposit of 50% of the tour fee must be paid to confirm a booking.
• The remaining balance is due before the start of the tour.
• Bookings are only confirmed once payment has been received and a confirmation receipt has been issued.

5.2 Cancellation and Terms:

• All tour terms and conditions follow our Subsidiary Unique Adventure Tours & Travel policies.
• Please refer to their website or contact them directly for detailed terms and cancellation policies.

6. Refund and Cancellation Policy

6.1 Refund Policy:

• Refund requests must be submitted in writing via email to info@aingkimsanbicycle.com.
• All refunds will be deducted from a 10% processing fee, which includes ABA bank charges (3%) and administrative expenses.
• Approved refunds will be processed within seven business days.
• Refunds will be issued via the original payment method unless otherwise agreed upon.
• Refunds do not include processing fees, bank transfer charges, or non-refundable deposits.

6.2 Service and Rental Cancellation:

• Full Refund Eligibility:
  • Customers who cancel at least 48 hours before the scheduled rental start time are eligible for a full refund.
  • Refunds will be processed within seven business days of the cancellation request, subject to a 10% administrative fee to cover ABA bank transaction fees and administrative costs.
• Partial Refunds:
  • Cancellations made 24-48 hours before the rental start time will incur a 50% cancellation fee.
• Non-Refundable:
  • Cancellations made less than 24 hours before the rental start time are non-refundable.
  • No refunds will be provided for early returns or unused rental periods.

6.3 Purchases of Bikes and Gears

• Return Period:
  • Returns are accepted within 14 days of purchase, provided the item is in unused, original condition, with tags and packaging intact.
• Refund Process:
  • Refunds will be issued using the original payment method within 7-10 business days after the product inspection.
  • All returned items except defective products are subject to a 10% restocking fee, which includes ABA bank transaction fees and administrative costs.
• Non-Refundable Items:
  • Custom-built bikes, clearance sale items, and gift cards are non-refundable.
  • Defective products will be repaired, replaced, or refunded at no additional cost.

7. Privacy Policy

We are committed to protecting your privacy. All personal data collected during transactions will be used solely to fulfill orders, rentals, or bookings. For more information, please refer to our detailed Privacy Policy on our website.

8. Amendments

The Company reserves the right to amend these Terms and Conditions without prior notice. Updates will be effective immediately upon being posted on our website. Customers are encouraged to review the Terms regularly.

9. Governing Law

The laws of the Kingdom of Cambodia govern these Terms and Conditions. Any disputes arising under these Terms will be resolved under the jurisdiction of the courts in Siem Reap.
